Terms of Use for ApartmentMaid

1. Acceptance of Terms

These Terms govern access to and use of the ApartmentMaid platform operated by APARTMENTMAIDCO LLC.

2. Company Information

APARTMENTMAIDCO LLC, Brooklyn, New York, United States.

3. Eligibility

Users must be legally capable of entering into a binding agreement and provide accurate information.

4. Services

ApartmentMaid offers one-time and recurring residential cleaning services. One-time services may be booked as a single booking or as multiple bookings in a single transaction. Recurring services include Weekly, Bi-Weekly, Monthly, and Custom Subscription plans. Custom Subscription plans allow customers to select different service types, durations, schedules, or frequencies, which may result in multiple independently managed recurring subscriptions.

5. Independent Service Providers

Cleaning professionals are independent contractors and are not employees, agents, or partners of ApartmentMaid.

6. User Accounts

Accounts may be created using Sign in with Apple, Google Sign-In, Email OTP, Phone OTP, or Magic Links.

7. Bookings and Scheduling

Customers are responsible for providing accurate booking, contact, and property information. Customers may schedule and pay for one or more one-time services in a single transaction. After purchase, each booking is treated as an individual booking and may be cancelled or rescheduled independently, subject to the applicable cancellation and refund policy. Cancelling or modifying one booking does not affect any remaining bookings included in the same transaction.

8. Cleaning Supplies

Customers are expected to provide cleaning supplies unless purchased as an add-on service.

9. Property Access

Customers are responsible for accurate access instructions. Incorrect access information may be treated as a customer no-show.

10. Cancellation Policy

Free cancellation up to 5 hours before the scheduled service. Late cancellations may incur fees of up to 50% of the affected booking value. For transactions containing multiple one-time bookings, cancellations, refunds, and applicable fees are determined individually for each cancelled booking.

11. Subscription Plans

Subscription plans may be Weekly, Bi-Weekly, Monthly, or Custom Subscription plans. Customers may purchase one or more recurring services in a single transaction. The first scheduled service for each recurring subscription is charged at checkout. Thereafter, ApartmentMaid will automatically charge the applicable subscription fee 3 days before each scheduled service date using the customer's saved payment method, unless the subscription has been cancelled in accordance with these Terms.

Where a Custom Subscription includes multiple recurring services or service configurations, each selected recurring service is created as a separate subscription and may be paused, skipped, rescheduled, or cancelled independently through the subscription management section of the Platform. Cancelling one subscription does not automatically cancel any other subscriptions created as part of the same purchase.

Customers may pause, skip, reschedule, or cancel a subscription at least 3 days before the scheduled service date. Requests made after this deadline may not prevent the scheduled automatic charge or the upcoming service.

12. Payments

Payments may be processed through Stripe, Apple Pay, or other approved payment processors made available by ApartmentMaid. Customers authorize ApartmentMaid to charge all applicable fees and taxes.

13. Satisfaction Guarantee

Quality concerns must be reported within 24 hours. ApartmentMaid may provide a touch-up, account credit, partial refund, or another reasonable remedy at its discretion.

14. Photo Documentation

Users may upload profile photos and support-related images. Support interactions may include image attachments through Intercom.

15. Pets and Safety

Customers are responsible for securing aggressive or dangerous animals. Unsafe conditions may result in suspension or termination of service.

16. Deep Cleaning and Move-Out Cleaning Limitations

ApartmentMaid does not guarantee stain removal, odor removal, mold remediation, restoration services, compliance with landlord requirements, or return of security deposits.

17. Damage Claims

Damage claims must be reported within 48 hours of service completion and supported by photographs and relevant information.

Customers are responsible for securing valuables before service and are strongly encouraged to remove or secure cash, jewelry, heirlooms, collectibles, antiques, artwork, documents, electronics, and other irreplaceable or high-value items prior to service.

ApartmentMaid may investigate reported damage and determine an appropriate resolution in its sole discretion.

For items alleged to be damaged, compensation, if any, shall be based on the item's reasonable fair market value, repair cost, or replacement cost as determined by ApartmentMaid in its sole discretion. Sentimental, emotional, personal, speculative, collectible, or non-economic value shall not be considered when determining compensation.

Any compensation, reimbursement, credit, or liability arising from a damage claim shall be subject to the limitations set forth in Section 21 (Limitation of Liability).

18. Theft Allegations

Theft allegations must be reported within 24 hours of service completion.

Customers must provide all relevant information reasonably requested by ApartmentMaid, including supporting evidence where available. ApartmentMaid may require a police report before any reimbursement request is considered.

ApartmentMaid reserves the right to investigate all theft allegations and may cooperate with law enforcement authorities where appropriate.

Customers are strongly encouraged to secure cash, jewelry, heirlooms, collectibles, antiques, artwork, documents, electronics, and other valuable or irreplaceable items before service.

Any reimbursement, credit, or liability arising from a theft-related claim shall be subject to the limitations set forth in Section 21 (Limitation of Liability).

19. Tipping

Tips are voluntary. Once a tip has been processed and transferred or allocated to the assigned cleaning professional, it is non-refundable except where required by applicable law.

20. Ratings and Reviews

Customers may submit ratings, reviews, comments, and feedback regarding services received through the Platform. By submitting a review, customers represent that it reflects their genuine experience and does not contain false, misleading, defamatory, abusive, discriminatory, unlawful, or infringing content.

By submitting a review or rating, customers grant ApartmentMaid a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, publish, display, and distribute the review in connection with the Platform, marketing, promotional materials, and service improvement initiatives.

ApartmentMaid may use customer feedback for internal analytics, quality assurance, and service improvement. ApartmentMaid reserves the right to moderate, remove, or decline to publish any review that violates these Terms or applicable law.

21. Disclaimer of Warranties

Services are provided on an AS IS and AS AVAILABLE basis.

21. Limitation of Liability

ApartmentMaid shall not be liable for indirect, incidental, consequential, special, punitive, exemplary, sentimental, emotional, or non-economic damages.

To the maximum extent permitted by law, ApartmentMaid's total aggregate liability arising from any service-related claim, property damage claim, negligence claim, booking dispute, theft allegation, or other claim related to the Platform or Services shall not exceed the amount paid by the customer for the specific service giving rise to the claim.

This limitation applies regardless of whether the claim arises under contract, negligence, tort, statute, or any other legal theory.

22. Indemnification

Users agree to indemnify and hold harmless APARTMENTMAIDCO LLC from claims arising from misuse of the Platform or violations of these Terms.

23. Intellectual Property

All Platform content, software, trademarks, and intellectual property belong to APARTMENTMAIDCO LLC or its licensors.

24. Suspension and Termination

ApartmentMaid may suspend or terminate accounts for fraud, abuse, illegal activity, chargeback abuse, or violations of these Terms.

25. User Account Deletion

Users may delete their account through the application. Active bookings must be completed or cancelled before deletion can proceed. Subscription auto-renewal will be cancelled and personal information may be deleted or anonymized.

26. Arbitration Agreement

Disputes shall be resolved exclusively through binding arbitration in New York, New York.

27. Class Action Waiver

Users agree to bring claims only in an individual capacity and waive participation in class actions.

28. Governing Law

These Terms are governed by the laws of the State of New York.

29. Changes to Terms

ApartmentMaid may update these Terms from time to time.
